FEDERAL FAIR DEBT COLLECTION PRACTICES ACT

Federal Fair Debt Collection Practices Act

The Federal Fair Debt Collection Practices Act limits the actions creditors and their agents can take in order to collect a debt in the United States. The goal of this act is to prevent creditors from being threatening or abusive to debtors, as well as from engaging in harassment. Unfortunately, creditors may not always follow these requirements. When creditors or debt collectors violate the provisions of this law, I can help you take action.

About FDCPA Violations

Some of the common debt collection tactics that are prohibited under the FDCPA include:

  • Threatening debtors with actions that can’t actually be taken.
  • Garnishing wages or bank accounts without a court order.
  • Pretending to be someone other than a debt collector.
  • Making false statements.
  • Harassing debtors, such as by calling at unreasonable hours, using obscene language, or contacting relatives.
